3. User Conduct and Cybersecurity

3.1 Lawful Use

Users agree to use the Platform only for lawful purposes, in compliance with applicable statutes and regulations, including but not limited to:

• Information Technology Act, 2000 (India)
• General Data Protection Regulation (GDPR) (EU)

• Relevant international cyber and IT laws.

3.2 Cybersecurity and Prohibited Activities

You must not:

• Deploy malware, viruses, or any harmful code that could disrupt Platform integrity or compromise user security.
• Engage in hacking, phishing, or fraudulent activity on the Platform.

SPF reserves the right to investigate any violation and may report illegal activities to relevant authorities.

4. Data Protection and Privacy

4.1 Personal Data Collection and Use

SPF collects and processes personal data in line with GDPR, CCPA, and Indian Information Technology Rules. Personal data is collected to provide, improve, and secure the Platform. By using the Platform, you consent to SPF's data collection, use, and disclosure practices as outlined in the Privacy Policy.

4.2 Data Security

SPF implements security protocols, encryption, and multi-factor authentication to safeguard user data, adhering to ISO 27001 and NIST cybersecurity standards. However, SPF cannot guarantee complete protection against unauthorized access, and users acknowledge the inherent security risks of online services.

In the event of a data breach, SPF will notify affected users and relevant authorities within the legally required timeframe under GDPR and Indian Cyber Laws.

• Violate any legal or regulatory standards.
• Be unlawful, harmful, or misleading.

SPF reserves the right to remove or block any user-generated content deemed inappropriate.

5.2 Grant of License

By submitting content to the Platform, you grant SPF a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display your content.

5.3 No Liability for User Content

SPF disclaims all liability for user-generated content that infringes on third-party rights or breaches applicable laws.

6. Data Retention and International Transfers

6.1 Data Retention Policy

In accordance with GDPR, CCPA, and Indian IT regulations, SPF retains personal data for as long as necessary to fulfill stated purposes or comply with legal obligations. Upon request or service termination, SPF will securely delete or anonymize user data in accordance with applicable law.

6.2 International Data Transfers

SPF may transfer personal data internationally, adhering to GDPR's Standard Contractual Clauses (SCCs) and Indian regulations on cross-border data transfer. SPF ensures adequate protection and legal safeguards for international data processing.

7. Payment Policies

Currently, SPF offers free access to the Platform. Should any paid services be introduced, they will be conducted in compliance with PCI-DSS (Payment Card Industry Data Security Standard), ensuring data protection and security for all payment-related information.

8. Disclaimer of Liability

8.1 General Disclaimer

The Platform and its content are provided "as is" without any warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose.

8.2 Limitation of Liability

SPF is not liable for damages arising from Platform use, data loss, unauthorized access, or cyber incidents, except as required by applicable law.

9. Indemnification

You agree to indemnify SPF, its affiliates, and partners against claims, damages, or expenses arising from any breach of these Terms or misuse of the Platform.

10. Modifications to Terms

SPF reserves the right to modify these Terms at any time. Your continued use of the Platform following modifications signifies your acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

This Agreement is governed by the laws of India. All disputes shall be resolved exclusively in the courts of New Delhi, India, and shall comply with Indian arbitration laws where applicable.
